UK Prosecutes Human Rights Lawyer for His Closing Speech Defending Palestine Action Activist

A senior British lawyer has been charged with criminal contempt of court over a closing speech he gave in defense of a Palestine Action activist, in what appears to be the first prosecution of its kind in British legal history.
Rajiv Menon KC, who has practiced at Garden Court Chambers for 30 years, is accused of encouraging jurors to acquit his client, Charlotte "Lottie" Head, according to their conscience rather than the law. Head was one of four Palestine Action activists sentenced as terrorists for a 2024 raid on a factory in Filton owned by Elbit Systems, a major supplier of weapons to Israel.
Menon told Democracy Now! he categorically denies breaching any judicial order, deliberately or otherwise. He said his closing speech, delivered on January 8, referenced a prior legal case and was not an attempt to instruct the jury to ignore the law.
What the judge's order says
Mr. Justice Nicklin's court order states that Menon made comments "capable of suggesting to the jury that the court was not impartial," specifically by telling jurors that defendants had been blocked from giving evidence about Elbit Systems, and by describing the company as "protected" and "wined and dined in the corridors of power."
Those are the judge's characterizations, laid out in a public order. Menon disputes the interpretation. He says he was informing jurors about legal precedent, not urging them to disregard their instructions.
Wider stakes
The sentencing of the four Palestine Action defendants marked, according to reporting on the case, the first time a British judge applied terrorism sentencing enhancements to people who were not convicted of terrorism offenses. An additional 21 jailed Palestine Action protesters could reportedly face similar treatment.
Garden Court Chambers called the charges against Menon unprecedented, saying they have "sent shockwaves through the legal profession." The chair of the Criminal Bar Association has said the prosecution has left barristers afraid to do their jobs. Amnesty International described the case as "a serious threat to fair trial rights and the right to protest."
Menon told Democracy Now! he believes the prosecution, paired with the UK government's decision to ban Palestine Action under anti-terrorism law, is designed to produce a chilling effect on pro-Palestine protest and carries "serious constitutional implications."
Why it matters
A government moving to criminalize a lawyer's closing argument is a direct strike at the machinery of a fair trial. The underlying protest targeted an Israeli arms supplier operating on British soil. If prosecutors can reach past defendants and into defense counsel's courtroom speech, the practical effect is to make representing Palestine solidarity activists riskier for every lawyer in the country, regardless of the outcome of Menon's own case.
